Arizona DUI law applies throughout AZ. Many cities have their own courts, and others contract with the local county court to provide this service. The police agency that arrested you for DUI will determine what Arizona court you are charged in. The court you are charged with DUI in will determine who your prosecutor is. Who your prosecutor is can have a decisive impact on your Arizona DUI case.

The location of your arrest and the arresting police agency impacts the jurisdiction of your case. For example, if you are pulled over by the Arizona Department of Public Safety (DPS) in Maricopa County, you will be charged in one of the Maricopa County Justice Courts, assuming that the DPS officer is the primary officer on your case. If you are in Phoenix and arrested by the Phoenix Police Department, you will be charged with DUI in Phoenix Municipal Court if it is a misdemeanor and in Maricopa County Superior Court if it is a felony. If the Maricopa County Sheriff's Office (MCSO, Sheriff Joe's department) arrests you, you will be in Maricopa County Court.

Each court follows a set of rules known as the Arizona Rules of Criminal Procedure. Some courts have local rules, while others do not. Each court also has its own local customs, that may or may not be published as formal rules. Make sure your lawyer is familiar with the local rules and customs of your court, and knows who is responsible for prosecuting in that jurisdiction.
